Scope of application and designation of parties

These general terms and conditions of sale are applicable to sales contracts concluded online via the lepechdandre.fr website between SAS Domaine du Pech d'André (us), registered with the Béziers Trade and Companies Registry under number 817 633 464, and its consumer customers (you).

The customer declares to have reached the legal age of majority, and undertakes to immediately provide SAS Domaine du Pech d'André, upon request, with any official proof mentioning his date of birth, in particular if his order is for alcoholic beverages, the sale of which is forbidden to minors.

The parties agree to use electronic mail as a privileged means of communication.

Conclusion of the contract

In accordance with the provisions of the Civil Code on the conclusion of online contracts, the contract will be concluded when you click on the button allowing you to confirm your order, after having reviewed the details of the order, and in particular its total price, and having had the opportunity to correct any errors. In this way, you acknowledge your obligation to pay.

Price

VAT is included in the prices displayed on our site at the currently applicable legal rate. The prices mentioned on our site are indicated all charges included, in euros. Delivery costs are not included in the prices displayed on our site. Any other additional costs that may be charged to you are indicated before the conclusion of the contract.

Delivery

The products offered for sale on our site can only be delivered in metropolitan France.

Delivery charges are invoiced in addition to the prices indicated on the site. The exact amount of delivery charges is indicated in the order process. The delivery time is a minimum of 1 week to a maximum of 2 weeks after receipt of payment for the order. In case of exceptional circumstances (pandemic in particular) this period may be extended to 3 weeks.

Payment

The following means of payment are available to you to pay for purchases made on our site:

  • Credit Card (secure online payment)
  • Paypal
  • Bank Transfer
  • Cheque (only for metropolitan France)

Please note that the preparation and delivery of your order will be triggered only after receipt of your payment by our services.

Retention of title

The transfer of ownership will take place after full payment of the price.

Transfer of risk

The transfer of the risks of deterioration or loss of the goods will take place when you take possession of the goods delivered or when the goods are handed over to a carrier appointed by you, other than one of those offered on our site.

Right of retraction

You have the right to withdraw from this contract without giving reasons within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, fax or e-mail) to the following address: Domaine du Pech d'André, 34210 AZILLANET, FRANCE.

You can use the model of the retraction letter below, but it is not mandatory. In order for the retraction period to be respected, it is sufficient that you send your communication relating to the exercise of the right of retraction before the retraction period expires.

Effects of withdrawal

If you withdraw from this Agreement, we will refund all payments received from you, including delivery charges (except for any additional charges arising from you choosing, where applicable, a method of delivery other than the cheaper standard method of delivery offered by us) without undue delay and in any event no later than fourteen days from the day we are notified of your decision to withdraw from this Agreement. We may postpone the refund until we have received the goods. We will make the refund using the same payment method you used for the original transaction, unless you expressly agree to a different method, in which case there will be no charge to you.

If the withdrawal concerns only part of the goods ordered, the delivery costs will be refunded in proportion to the value of the goods returned in relation to the total price of the order.

You must return or return the goods to us at the above address without undue delay and in any event no later than fourteen days after you have communicated your decision to withdraw from this contract. This period shall be deemed to have been observed if you return the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.

Returns are to be made in their original condition (packaging) allowing them to be remarketed as new. Damaged or soiled goods will not be taken back.

Legal guarantee

You can make a request under the legal guarantee of conformity provided for in Articles L 211-4 and following of the Consumer Code or under the guarantee of defects of the thing sold within the meaning of Articles 1641 and following of the Civil Code with us: Domaine du Pech d'André, 34210 AZILLANET, France.

Archiving

The contracts concluded on our website (order data and GTCs in force on the day of your order) are archived for a period of 10 years. You can access the archived contracts by making a request by e-mail to contact@lepechdandre.fr or by post addressed to Domaine du Pech d'André, 34210 AZILLANET, France.

Applicable law - Language

The present General Terms and Conditions of Sale and the operations arising therefrom are governed and subject to French law.

The present General Terms and Conditions of Sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall be deemed authentic in the event of a dispute.
